*  *  *   UPDATE - New Fair Labor Standards Act Changes Put On Hold   *  *  *

Many of you are aware of the change to the Fair Labor Standards Act (FLSA) and the changes in the exempt/non-exempt classifications for the College.  In September 2016, twenty-one states (including Utah) sued the Department of Labor (DOL) in a federal court in Texas seeking to stop the Department of Labor’s (DOL) final rule that more than doubles the salary threshold for the so-called white collar exemptions and calls for automatic increases every three years. 

On November 22, 2016,  a U.S. District Court judge issued a preliminarily injunction postponing the effective date of the U.S. Department of Labor’s (DOL) overtime rule. 

What the means for the College is that we will not implement any changes to employees exempt/non-exempt status until this is resolved by the courts.  If your position is currently exempt, your FLSA status will remain exempt or if your position is currently non-exempt, your FLSA status will remain non-exempt.
